DMCA Policy

3. How to Submit a DMCA Takedown Notice

To be effective under 17 U.S.C. § 512(c)(3), your notice must include the following:

A. Signature

Your physical or electronic signature. A typed full legal name at the end of your email is generally acceptable.

B. Identification of Copyrighted Work

A description of the copyrighted work you believe has been infringed. If multiple works are involved, you may provide a representative list.

C. Identification of Infringing Material

Information reasonably sufficient to allow us to locate the allegedly infringing material, including:

  • Product URLs

  • Website URLs

  • Screenshots

  • Images

  • Other identifying information

D. Contact Information

Please provide:

  • Full legal name

  • Mailing address

  • Telephone number

  • Email address

E. Good-Faith Statement

Include the following statement:

"I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

F. Accuracy Statement

Include the following statement:

"The information contained in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Incomplete notices may not be processed. We may share portions of your notice with the affected user or third parties when required by law.

4. Our Response to Valid Notices

Upon receipt of a valid DMCA notice, Printsygift may:

  • Review the notice for completeness and legal sufficiency.

  • Remove or disable access to the allegedly infringing content.

  • Notify the affected user, designer, contributor, or customer.

  • Request additional information if clarification is necessary.

We reserve the right to determine the appropriate action based on the information available and applicable law.

5. Counter-Notification Procedure

If your content has been removed or disabled due to a DMCA notice and you believe the action was made in error or misidentification, you may submit a counter-notification.

To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include:

A. Signature

Your physical or electronic signature.

B. Identification of Removed Material

Identification of the content that was removed and the location where it appeared before removal, including the specific URL.

C. Good-Faith Statement

A statement under penalty of perjury that you have a good-faith belief the content was removed due to mistake or misidentification.

D. Contact Information

Provide:

  • Full legal name

  • Mailing address

  • Telephone number

  • Email address

E. Jurisdiction Statement

Include the following statement:

"I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or, if my address is outside the United States, I consent to the jurisdiction of any Federal District Court in which Printsygift may be found, and I will accept service of process from the person who submitted the original notification or that person's agent."

Upon receipt of a valid counter-notification, we may restore the material within 10–14 business days unless we receive notice that legal proceedings have been initiated regarding the disputed content.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Printsygift reserves the right to suspend, restrict, terminate, or refuse service to users who are determined to be repeat copyright infringers.

We may also:

  • Remove content or product listings

  • Disable content submission features

  • Restrict access to our services

  • Cancel orders involving potentially infringing content

whether or not a formal DMCA notice has been filed.

7. Misrepresentations

Under the DMCA, any person who knowingly misrepresents:

  • That material is infringing; or

  • That material was removed due to mistake or misidentification

may be liable for damages, including legal costs and attorneys' fees.

Please ensure that all DMCA notices and counter-notifications are submitted truthfully and in good faith.

8. Changes to This DMCA Policy

Printsygift reserves the right to modify this DMCA Policy at any time.

Updates will be posted on this page together with a revised Effective Date. Continued use of the Site after changes are published constitutes acceptance of the updated Policy.
